INTER-AMERICAN=20 CONVENTION AGAINST TERRORISM =20

(Adopted=20 at the second plenary session held on June 3, 2002) =20

           =20 THE GENERAL ASSEMBLY,

           =20 REAFFIRMING the principles and provisions contained in the = Charter of=20 the Organization of American States and the Charter of the United=20 Nations;

           =20 RECOGNIZING=20 the threat that terrorism poses to democratic values and international = peace=20 and security, and that it is a source of profound concern to all = member=20 states; =20

           =20 CONVINCED that the Charter of the Organization of American = States and=20 international law constitute the appropriate framework for = strengthening=20 hemispheric cooperation for the prevention, combating, and elimination = of=20 terrorism in all its forms and manifestations; =

           =20 BEARING IN MIND resolution RC.23/RES. 1/01 rev. 1 corr. 1,=20 =93Strengthening Hemispheric Cooperation to Prevent, Combat, and = Eliminate=20 Terrorism,=94 =20 of the Twenty-Third Meeting of Consultation of the Ministers of = Foreign=20 Affairs of September 21, 2001, which entrusted the Permanent Council = with=20 preparing a Draft Inter-American Convention against Terrorism ; =20
          =20 RECALLING the Declaration of Lima = to=20 Prevent, Combat, and Eliminate Terrorism and the Plan of Action on = Hemispheric=20 Cooperation to Prevent, Combat, and Eliminate Terrorism ,=20 adopted within the framework of the First Inter-American Specialized=20 Conference on Terrorism, in Lima, Peru, in April 1996, as well as the=20 Commitment of Mar del Plata ,=20 adopted at the Second Inter-American Specialized Conference on = Terrorism, and=20 the work of the Inter-American Committee against Terrorism=20 (CICTE);

           =20 CONSIDERING that terrorism is a serious criminal phenomenon, = which is=20 of deep concern to all member states; attacks democracy; impedes the = enjoyment=20 of human rights and fundamental freedoms; threatens the security of = states,=20 destabilizing and undermining the foundations of all society; and = seriously=20 impacts the economic and social development of the states in the = region;=20

           =20 BEARING=20 IN MIND that the Inter-American Democratic Charter recognizes the = commitment=20 by member states to promote and defend representative democracy and = that no=20 democratic state can be indifferent to the clear threat that terrorism = poses=20 to democratic institutions and freedoms;

           =20 REAFFIRMING that the fight against terrorism must be undertaken = with=20 full respect for national and international law, human rights, and = democratic=20 institutions, in order to preserve the rule of law, liberties and = democratic=20 values in the Hemisphere, which are essential components of a = successful fight=20 against terrorism; =20

           =20 CONVINCED that the adoption, ratification, and effective = implementation=20 of the Inter-American Convention against Terrorism contribute to the=20 progressive development and the codification of international = law; =20

           =20 UNDERSCORING the importance of effective action in cutting off = the=20 supply of funds for terrorism, and of coordinated action with = international=20 entities competent in the area of money laundering, especially the=20 Inter-American Drug Abuse Control Commission (CICAD); =20

           =20 RECOGNIZING=20 the urgency of strengthening and establishing new forms of regional=20 cooperation against terrorism with a view to its eradication; = and =20

           =20 RECOGNIZING the importance and timeliness of the existing = international=20 legal instruments on combating terrorism, including the 10 = international=20 instruments considered for the text of the Inter-American Convention = against=20 Terrorism itself, as well as the Convention to Prevent and Punish the = Acts of=20 Terrorism Taking the Forms of Crimes against Persons and Related = Extortion=20 That Are of International Significance, adopted by the General = Assembly itself=20 on February 2, 1971; the Convention on Offences and Certain Other Acts = Committed on Board Aircraft, adopted in Tokyo on September 14, 1963; = and the=20 Convention on the Marking of Plastic Explosives for the Purpose of = Detection,=20 adopted in Montreal on March 1, 1991, =20

RESOLVES: =20

           =20 1.           =20 To adopt the Inter-American Convention against Terrorism = attached to=20 this resolution and to open it for signature by the member states on = this=20 date.

           =20 2.           =20 To urge member states to ratify the Convention as soon as = possible, in=20 accordance with their constitutional procedures. =

           =20 3.           =20 To request the Secretary General to present a report to the = General=20 Assembly at its thirty-third regular session on progress made toward = the=20 Convention=92s entry into force.

INTER-AMERICAN=20 CONVENTION AGAINST TERRORISM

           =20 The States Parties to this Convention, =20

           =20 BEARING IN MIND the purposes and principles of the Charter of = the=20 Organization of American States and the Charter of the United=20 Nations;

           =20 CONSIDERING that terrorism represents a serious threat to = democratic=20 values and to international peace and security and is a cause of = profound=20 concern to all member states;

           =20 REAFFIRMING the need to adopt effective steps in the = inter-American=20 system to prevent, punish, and eliminate terrorism through the = broadest=20 cooperation;

           =20 RECOGNIZING that the serious economic harm to states which may = result=20 from terrorist acts is one of the factors that underscore the need for = cooperation and the urgency of efforts to eradicate = terrorism; =20

           =20 REAFFIRMING the commitment of the states to prevent, combat, = punish,=20 and eliminate terrorism; and

           =20 BEARING IN MIND resolution RC.23/RES. 1/01 rev. 1 corr. 1,=20 =93Strengthening Hemispheric Cooperation to Prevent, Combat, and = Eliminate=20 Terrorism,=94 adopted at the Twenty-third Meeting of Consultation of = Ministers=20 of Foreign Affairs, =20

           =20 Have agreed to the following: =20
Article=20 1
Object = and=20 purposes =20

           =20 The purposes of this Convention are to prevent, punish, and = eliminate=20 terrorism. To that end, = the=20 states parties agree to adopt the necessary measures and to strengthen = cooperation among them, in accordance with the terms of this=20 Convention. =20

Article=20 2

Applicable=20 international instruments =20

           =20 1.           =20 For the purposes of this Convention, =93offenses=94 means the = offenses=20 established in the international instruments listed below: =20

a. Convention for the Suppression of = Unlawful=20 Seizure of Aircraft, signed at The Hague on December 16, = 1970. =20

b. Convention for the Suppression of = Unlawful=20 Acts against the Safety of Civil Aviation, signed at Montreal on = September 23,=20 1971. =20

c. Convention on the Prevention and = Punishment=20 of Crimes against Internationally Protected Persons, including = Diplomatic=20 Agents, adopted by the General Assembly of the United Nations on = December 14,=20 1973. =20

d. International Convention against = the Taking=20 of Hostages, adopted by the General Assembly of the United Nations on = December=20 17, 1979.

e. Convention on the Physical = Protection of=20 Nuclear Material, signed at Vienna on March 3, 1980. =20

f. Protocol on the Suppression of = Unlawful Acts=20 of Violence at Airports Serving International Civil Aviation, = supplementary to=20 the Convention for the Suppression of Unlawful Acts against the Safety = of=20 Civil Aviation, signed at Montreal on February 24, 1988. =20

g. Convention for the Suppression of = Unlawful=20 Acts against the Safety of Maritime Navigation, done at Rome on March = 10,=20 1988.

h. Protocol for the Suppression of = Unlawful Acts=20 against the Safety of Fixed Platforms Located on the Continental = Shelf, done=20 at Rome on March 10, 1988.

i. International Convention for the = Suppression=20 of Terrorist Bombings, adopted by the General Assembly of the United = Nations=20 on December 15, 1997.

j. International Convention for the = Suppression=20 of the Financing of Terrorism, adopted by the General Assembly of the = United=20 Nations on December 9, 1999. =20

           =20 2.           =20 Upon depositing its instrument of ratification to this = Convention, a=20 state party that is not a party to one or more of the international=20 instruments listed in paragraph 1 of this article may declare that, in = application of this Convention to such state party, that particular = instrument=20 shall be deemed not to be included in that paragraph. The declaration shall cease = to have=20 effect as soon as that instrument enters into force for that state = party,=20 which shall notify the depositary of this fact. =

           =20 3.           =20 When a state party ceases to be a party to one of the = international=20 instruments listed in paragraph 1 of this article, it may make a = declaration,=20 as provided in paragraph 2 of this article, with respect to that=20 instrument.

Article=20 3

Domestic=20 measures =20

           =20 Each state party, in accordance with the provisions of its=20 constitution, shall endeavor to become a party to the international=20 instruments listed in Article 2 to which it is not yet a party and to = adopt=20 the necessary measures to effectively implement such instruments, = including=20 establishing, in its domestic legislation, penalties for the offenses=20 described therein. =20

Article=20 4=20

Measures=20 to prevent, combat, and eradicate the financing of = terrorism =20

           =20 1.           =20 Each state party, to the extent it has not already done so, = shall=20 institute a legal and regulatory regime to prevent, combat, and = eradicate the=20 financing of terrorism and for effective international cooperation = with=20 respect thereto, which shall include:

a. A comprehensive domestic regulatory = and=20 supervisory regime for banks, other financial institutions, and other = entities=20 deemed particularly susceptible to being used for the financing of = terrorist=20 activities. This regime = shall=20 emphasize requirements for customer identification, record-keeping, = and the=20 reporting of suspicious or unusual transactions. =20

b. Measures to detect and monitor = movements=20 across borders of cash, bearer negotiable instruments, and other = appropriate=20 movements of value. = These=20 measures shall be subject to safeguards to ensure proper use of = information=20 and should not impede legitimate capital movements. =20

c. Measures to ensure that the = competent=20 authorities dedicated to combating the offenses established in the=20 international instruments listed in Article 2 have the ability to = cooperate=20 and exchange information at the national and international levels = within the=20 conditions prescribed under its domestic law. To that end, each state = party shall=20 establish and maintain a financial intelligence unit to serve as a = national=20 center for the collection, analysis, and dissemination of pertinent = money=20 laundering and terrorist financing information. Each state party shall = inform the=20 Secretary General of the Organization of American States of the = authority=20 designated to be its financial intelligence unit. =20

           =20 2.           =20 When implementing paragraph 1 of this article, states parties = shall use=20 as guidelines the recommendations developed by specialized = international and=20 regional entities, in particular the Financial Action Task Force and, = as=20 appropriate, the Inter-American Drug Abuse Control Commission, the = Caribbean=20 Financial Action Task Force, and the South American Financial Action = Task=20 Force. =20

Article=20 5

Seizure=20 and confiscation of funds or other assets =20

  =20          1.           =20 Each state party shall, in accordance with the procedures = established=20 in its domestic law, take such measures as may be necessary to provide = for the=20 identification, freezing or seizure for the purposes of possible = forfeiture,=20 and confiscation or forfeiture, of any funds or other assets = constituting the=20 proceeds of, used to facilitate, or used or intended to finance, the=20 commission of any of the offenses established in the international = instruments=20 listed in Article 2 of this Convention. =20

           =20 2.           =20 The measures referred to in paragraph 1 shall apply to offenses = committed both within and outside the jurisdiction of the state=20 party.

Article=20 6=20

Predicate=20 offenses to money laundering =20

1.           =20 Each state party shall take the necessary measures to ensure = that its=20 domestic penal money laundering legislation also includes as predicate = offenses those offenses established in the international instruments = listed in=20 Article 2 of this Convention. =20

2.           =20 The money laundering predicate offenses referred to in = paragraph 1=20 shall include those committed both within and outside the jurisdiction = of the=20 state party. =20

Article=20 7

Cooperation=20 on border controls =20

           =20 1.           =20 The states parties, consistent with their respective domestic = legal and=20 administrative regimes, shall promote cooperation and the exchange of=20 information in order to improve border and customs control measures to = detect=20 and prevent the international movement of terrorists and trafficking = in arms=20 or other materials intended to support terrorist = activities. =20

           =20 2.           =20 In this context, they shall promote cooperation and the = exchange of=20 information to improve their controls on the issuance of travel and = identity=20 documents and to prevent their counterfeiting, forgery, or fraudulent=20 use.

           =20 3.           =20 Such measures shall be carried out without prejudice to = applicable=20 international commitments in relation to the free movement of people = and the=20 facilitation of commerce. =20

Article=20 8

Cooperation=20 among law enforcement authorities =20

The=20 states parties shall work closely with one another, consistent with = their=20 respective domestic legal and administrative systems, to enhance the=20 effectiveness of law enforcement action to combat the offenses = established in=20 the international instruments listed in Article 2. In this context, they shall = establish=20 and enhance, where necessary, channels of communication between their=20 competent authorities in order to facilitate the secure and rapid = exchange of=20 information concerning all aspects of the offenses established in the=20 international instruments listed in Article 2 of this = Convention. =20

Article=20 9

Mutual=20 legal assistance =20

           =20 The states parties shall afford one another the greatest = measure of=20 expeditious mutual legal assistance with respect to the prevention,=20 investigation, and prosecution of the offenses established in the=20 international instruments listed in Article 2 and proceedings related = thereto,=20 in accordance with applicable international agreements in force. In the absence of such = agreements,=20 states parties shall afford one another expeditious assistance in = accordance=20 with their domestic law.

Article=20 10

Transfer=20 of persons in custody =20

           =20 1.           =20 A person who is being detained or is serving a sentence in the=20 territory of one state party and whose presence in another state party = is=20 requested for purposes of identification, testimony, or otherwise = providing=20 assistance in obtaining evidence for the investigation or prosecution = of=20 offenses established in the international instruments listed in = Article 2 may=20 be transferred if the following conditions are met: =20

           =20            =20 a.           =20 The person freely gives his or her informed consent; = and =20

b.   =20          Both states = agree,=20 subject to such conditions as those states may deem = appropriate. =20

           =20 2.           =20 For the purposes of this article:

a. The state to which the person is = transferred=20 shall have the authority and obligation to keep the person transferred = in=20 custody, unless otherwise requested or authorized by the state from = which the=20 person was transferred. =20

b. The state to which the person is = transferred=20 shall without delay implement its obligation to return the person to = the=20 custody of the state from which the person was transferred as agreed=20 beforehand, or as otherwise agreed, by the competent authorities of = both=20 states. =20

c. The state to which the person is = transferred=20 shall not require the state from which the person was transferred to = initiate=20 extradition proceedings for the return of the person. =20

d. The person transferred shall = receive, for=20 time spent in the custody of the state to which he or she was = transferred,=20 credit toward service of the sentence being served in the state from = which he=20 or she was transferred.

           =20 3.           =20 Unless the state party from which a person is to be transferred = in=20 accordance with the present article so agrees, that person, whatever = his or=20 her nationality, shall not be prosecuted or detained or subjected to = any other=20 restriction of his or her personal liberty in the territory of the = state to=20 which that person is transferred in respect of acts or convictions = prior to=20 his or her departure from the territory of the state from which said = person=20 was transferred.

Article=20 11

Inapplicability=20 of political offense exception =20

           =20 For the=20 purposes of extradition or mutual legal assistance, none of the = offenses=20 established in the international instruments listed in Article 2 shall = be=20 regarded as a political offense or an offense connected with a = political=20 offense or an offense inspired by political motives. Accordingly, a request for = extradition=20 or mutual legal assistance may not be refused on the sole ground that = it=20 concerns a political offense or an offense connected with a political = offense=20 or an offense inspired by political motives. =20

Article=20 12=20

Denial=20 of refugee status =20

           =20 Each state party shall take appropriate measures, consistent = with the=20 relevant provisions of national and international law, for the purpose = of=20 ensuring that refugee status is not granted to any person in respect = of whom=20 there are serious reasons for considering that he or she has committed = an=20 offense established in the international instruments listed in Article = 2 of=20 this Convention.

Article=20 13

Denial=20 of asylum =20

           =20 Each state party shall take appropriate measures, consistent = with the=20 relevant provisions of national and international law, for the purpose = of=20 ensuring that asylum is not granted to any person in respect of whom = there are=20 reasonable grounds to believe that he or she has committed an offense=20 established in the international instruments listed in Article 2 of = this=20 Convention. =20

Article=20 14

Nondiscrimination =20

           =20 None of the provisions of this Convention shall be interpreted = as=20 imposing an obligation to provide mutual legal assistance if the = requested=20 state party has substantial grounds for believing that the request has = been=20 made for the purpose of prosecuting or punishing a person on account = of that=20 person=92s race, religion, nationality, ethnic origin, or political = opinion, or=20 that compliance with the request would cause prejudice to that = person=92s=20 position for any of these reasons. =20

Article=20 15

Human=20 rights =20

           =20 1.           =20 The measures carried out by the states parties under this = Convention=20 shall take place with full respect for the rule of law, human rights, = and=20 fundamental freedoms.

           =20 2.           =20 Nothing in this Convention shall be interpreted as affecting = other=20 rights and obligations of states and individuals under international = law, in=20 particular the Charter of the United Nations, the Charter of the = Organization=20 of American States, international humanitarian law, international = human rights=20 law, and international refugee law. =20

           =20 3.           =20 Any person who is taken into custody or regarding whom any = other=20 measures are taken or proceedings are carried out pursuant to this = Convention=20 shall be guaranteed fair treatment, including the enjoyment of all = rights and=20 guarantees in conformity with the law of the state in the territory of = which=20 that person is present and applicable provisions of international=20 law. =20

Article=20 16=20

Training =20

           =20 1.           =20 The states parties shall promote technical cooperation and = training=20 programs at the national, bilateral, subregional, and regional levels = and in=20 the framework of the Organization of American States to strengthen the = national institutions responsible for compliance with the obligations = assumed=20 under this Convention.

           =20 2.           =20 The states parties shall also promote, where appropriate, = technical=20 cooperation and training programs with other regional and = international=20 organizations conducting activities related to the purposes of this=20 Convention. =20

Article=20 17=20

Cooperation=20 through the Organization of American States =20

The=20 states parties shall encourage the broadest cooperation within the = pertinent=20 organs of the Organization of American States, including the = Inter-American=20 Committee against Terrorism (CICTE), on matters related to the object = and=20 purposes of this Convention. =20

Article=20 18

Consultations=20 among the parties =20

           =20 1.           =20 The states parties shall hold periodic meetings of = consultation, as=20 appropriate, with a view to facilitating:

a. The full implementation of this = Convention,=20 including the consideration of issues of interest relating thereto = identified=20 by the states parties; and =20

b. The exchange of information and = experiences=20 on effective means and methods to prevent, detect, investigate, and = punish=20 terrorism. =20

           =20 2.           =20 The Secretary General shall convene a meeting of consultation = of the=20 states parties after receiving the 10th instrument of = ratification. Without prejudice to this, = the states=20 parties may hold consultations as they consider = appropriate. =20

           =20 3.           =20 The states parties may request the pertinent organs of the = Organization=20 of American States, including CICTE, to facilitate the consultations = referred=20 to in the previous paragraphs and to provide other forms of assistance = with=20 respect to the implementation of this Convention. =20

Article=20 19

Exercise=20 of jurisdiction =20

           =20 Nothing in this Convention entitles a state party to undertake = in the=20 territory of another state party the exercise of jurisdiction or = performance=20 of functions that are exclusively reserved to the authorities of that = other=20 state party by its domestic law. =20

Article=20 20

Depositary =20

           =20 The original instrument of this Convention, the English, = French,=20 Portuguese, and Spanish texts of which are equally authentic, shall be = deposited with the General Secretariat of the Organization of American = States. =20

Article=20 21=20

Signature=20 and ratification =20

           =20 1.           =20 This Convention is open for signature by all member states of = the=20 Organization of American States.

           =20 2.           =20 This Convention is subject to ratification by the signatory = states in=20 accordance with their respective constitutional procedures. The instruments of = ratification shall=20 be deposited with the General Secretariat of the Organization of = American=20 States. =20

Article=20 22

Entry=20 into force =20

           =20 1.           =20 This Convention shall enter into force on the 30th day = following the=20 date of deposit of the sixth instrument of ratification of the = Convention with=20 the General Secretariat of the Organization of American = States. =20

           =20 2.           =20 For each state ratifying the Convention after deposit of the = sixth=20 instrument of ratification, the Convention shall enter into force on = the 30th=20 day following the deposit by such state of its instrument of=20 ratification.

Article=20 23=20

Denunciation =20

           =20 1.           =20 Any state party may denounce this Convention by written = notification to=20 the Secretary General of the Organization of American States. Denunciation shall take = effect one=20 year following the date on which notification is received by the = Secretary=20 General of the Organization.

           =20 2.           =20 Such denunciation shall not affect any requests for information = or=20 assistance made during the time the Convention is in force for the = denouncing=20 state.
